Terms of Service

These terms govern use of the Moment Marketing Engine platform and this website (together, "the Platform"), operated by HumAIn Technologies ("HumAIn", "we", "us"), a United Kingdom business. By using the Platform you agree to these terms.

What the Platform does

The Platform helps clients create short-form content, review and approve it, and publish approved content to the client's own connected channels. Nothing is published from a client's account without an explicit approval step by that client.

Accounts

Clients are responsible for keeping their login credentials secure and for the accuracy of the information they provide. You must be authorised to act for any business or artist on whose behalf you use the Platform.

Your content

Clients keep ownership of the content they create, upload or approve. You confirm you have the rights needed for anything you provide — including music, images and footage — and that your content is lawful and does not infringe anyone else's rights. You grant us the limited licence needed to operate the Platform for you: to host, process, render and, on your approval, publish your content to your connected channels.

Acceptable use

You may not use the Platform to publish unlawful, deceptive, infringing or harmful content; to send spam; to interfere with the Platform's operation or security; or to breach the terms of any connected third-party platform.

Connected platforms

Publishing to TikTok, Facebook, Instagram, YouTube or any other third-party service is subject to that service's own terms and policies, which you accept when you connect your account there. We are not affiliated with those services, and you can revoke the Platform's access to a connected account at any time from that service's settings. Features that depend on a third-party service may change or become unavailable if that service changes.

Service availability

We work to keep the Platform reliable but provide it "as is" and do not promise it will be uninterrupted or error-free. We may improve or change features over time.

Liability

Nothing in these terms limits liability that cannot lawfully be limited. Otherwise, we are not liable for indirect or consequential losses, loss of profits, or loss of data arising from use of the Platform, and our total liability in connection with the Platform is limited to the amounts paid to us for the service in the twelve months before the claim arose.

Ending use

Clients may stop using the Platform at any time, subject to any separate service agreement. We may suspend or end access for breach of these terms, giving notice where reasonable.

General

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If any part of these terms is found unenforceable, the rest remains in effect. Where a client has a separate written agreement with HumAIn, that agreement takes precedence over these terms.
